In these terms and conditions of business (“Terms”, "terms"), “HERBAL Nutrition for LIFE™" means Herbalife^® Independent Members Paul and Beccy Hopfensperger who trade via Body and Mind Studio International Ltd (BMSIL) trading as “HERBAL Nutrition for LIFE™", a company registered in England and Wales number 06757605 with it's trading address at PO Box 825, Bury St Edmunds, Suffolk, IP33 9QQ, United kingdom; “goods” means the goods and/or services to be supplied by HERBAL Nutrition for LIFE™ to the client in accordance with goods and/or services offered on the HERBAL Nutrition for LIFE™ website ("the website" or "website" - www.HerbalNutritionForLife.com), leaflets and/or other verbal/written communications; and “the client” means the person who visits the website, accepts HERBAL Nutrition for LIFE™’s quotation, website(s) and/or leaflet pricing for the supply of goods or whose order for the goods is accepted by HERBAL Nutrition for LIFE™ and where the client comprises two or more persons their liability shall be joint and several.

By visiting our website and/or purchasing goods from us, the client engages in our “Service” or "Services" and agrees to be bound by the terms including those additional terms and conditions and policies referenced herein and/or available by hyperlink. HERBAL Nutrition for LIFE™ may provide the client with access to third-party tools over which we neither monitor nor have any control nor input.

The client acknowledges and agree that HERBAL Nutrition for LIFE™ provides access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. HERBAL Nutrition for LIFE™ shall have no liability whatsoever arising from or relating to the clients use of optional third-party tools.

Any use by the client of optional tools offered through the website is entirely at the client's own risk and discretion and the client should ensure that they are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

HERBAL Nutrition for LIFE™ may also, in the future, offer new services and/or features through this website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these terms.

The client agrees to indemnify, defend and hold harmless HERBAL Nutrition for LIFE™ and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable lawyers’ fees, made by any third-party due to or arising out of your breach of these terms or the documents they incorporate by reference, or the client's violation of any law or the rights of a third-party.

SECTION 16 - SEVERABILITY

In the event that any provision of these terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 17 - TERMINATION

The obligations and liabilities of HERBAL Nutrition for LIFE™ and the client ("the parties") incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These terms are effective unless and until terminated by either the client or HERBAL Nutrition for LIFE™. You may terminate these terms at any time by notifying HERBAL Nutrition for LIFE™ that you no longer wish to use our services, or when you cease using our site.

If in the sole judgment of HERBAL Nutrition for LIFE™ the client fails, or we suspect that the client has failed, to comply with any term or provision of these terms, HERBAL Nutrition for LIFE™ also may terminate this agreement at any time without notice and the client will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny the client access to HERBAL Nutrition for LIFE™'s services (or any part thereof).

SECTION 18 - ENTIRE AGREEMENT

The failure of HERBAL Nutrition for LIFE™ to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

These terms and any policies or operating rules posted by HERBAL Nutrition for LIFE™ on this site or in respect to the service constitutes the entire agreement and understanding between the parties and govern the client's use of the service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between the parties (including, but not limited to, any prior versions of the terms).

Any ambiguities in the interpretation of these terms shall not be construed against the drafting party.

SECTION 19 - GOVERNING LAW

This contract will be governed by and construed in accordance with the laws of the United Kingdom and shall be subject to the non-exclusive jurisdiction of the court of Great Britain.

HERBAL Nutrition for LIFE™ reserves the right, at our sole discretion, to update, change or replace any part of these terms by posting updates and changes to our website.
